being allowed to participate in activities at the Nolfpack Wrestling Academy (the “Academy”), a wrestling school, the undersigned acknowledges and agrees that:
The risks of injury to my child/dependent stemming from the activities at the Academy, which typically involve wrestling and related training which includes but is not limited to lifting weights, running, gymnastics, and other extremely physical exercises are significant and may include permanent disability, illness and/or death. Furthermore, intending to be legally bound, I agree to the following:
1. FOR MYSELF, SPOUSE, CHILD AND/OR DEPENDENT, I KNOWINGLY AND WILLINGLY ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, EVEN THOSE ARISING FROM THE NEGLIGENCE OF OTHERS AND ASSUME FULL RESPONSIBILITY FOR THE PARTICIPATION OF MY CHILD/DEPENDENT;
2. I willingly agree that my child is willing and able to participate in activities at the Academy. If I observe any unusual and/or significant concern in my child’s readiness for participation in the Academy itself, I will remove my child/dependent from the participation and bring such attention to the nearest coach immediately.
3. I, for myself, my spouse, my child/dependent, and on behalf of my/our heirs, assigns and personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS, THE ACADEMY AND ITS RELATED AFFILIATES, ALONG WITH ITS OWNERS, DIRECTORS, OFFICERS, OFFICIALS, AGENTS, EMPLOYEES, VOLUNTEERS, COACHES, OTHER PARTICIPANTS, SPONSORS, OWNERS AND LESSORS OF THE BUILDING WHERE THE ACADEMY IS HOUSED, WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DAMAGE, DISABILITY, DEATH, LOSS TO PERSON OR PROPERTY STEMMING FROM ANY INCIDENT OR OCCURRENCE AT THE ACADEMY OR MY CHILD’S/DEPENDENT’S PARTICIPATION IN THE ACTIVITIES AT THE ACADEMY, WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF OTHERS, TO THE FULLEST EXTENT PERMITTED BY LAW.
4. I, for myself, my spouse, my child/dependent, and on behalf of my/our heirs, assigns and personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all those set forth in No. 3 above from all liability incident to involvement and/or participation at the Academy, to the fullest extent permitted by law.
5. I fully understand the physically strenuous activities that take place at the Academy and have fully explained the risks of such activities to my child or dependent.
6. Any and all disputes in any way related to this Waiver shall be governed by the laws of the State of Texas, with the appropriate venue in Williamson County, Texas.
I, FOR MYSELF, MY SPOUSE, AND MY CHILD/DEPENDENT, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
